These Terms & Conditions apply to all purchases made online via the Deli Fresco website and in-store at Deli Fresco locations.

1. General

By accessing our website or purchasing goods from Deli Fresco, you agree to be bound by these Terms & Conditions. We reserve the right to update these terms at any time without notice.

2. Products, Pricing & Descriptions

  • All products are offered subject to availability and may be withdrawn at any time.
  • Product images and descriptions are for illustrative purposes only.
  • Due to the nature of fresh and handmade food products, weights, sizes, ingredients and presentation may vary.
  • Prices are displayed in Australian Dollars (AUD) and include GST unless stated otherwise.
  • We reserve the right to correct pricing or listing errors and cancel affected orders with a full refund.

3. Orders & Acceptance

  • Placing an order does not constitute acceptance.
  • An order is only accepted once payment has been processed and confirmation issued.
  • We reserve the right to refuse or cancel any order prior to fulfilment for reasons including stock availability, pricing errors, delivery constraints, or suspected misuse.

4. Payments

  • All online orders must be paid in full at checkout.
  • Payments are processed securely by third-party payment providers.
  • We do not store full credit card details.

5. Click & Collect

  • Customers must collect orders within the nominated time window.
  • Orders not collected within a reasonable time may be deemed abandoned.
  • Perishable goods not collected may be disposed of for food safety reasons without refund.
  • Risk passes to the customer once the order is made available for collection.

6. Delivery

  • Delivery times are estimates only and not guaranteed.
  • We are not responsible for delays caused by third-party couriers, weather events, traffic conditions or incorrect delivery details supplied by the customer.
  • Risk passes to the customer once delivery is completed to the nominated address.
  • Customers must ensure refrigerated or frozen goods are promptly stored on delivery.

7. Food Safety & Allergens

  • We take reasonable care in handling food products, however we do not guarantee an allergen-free environment.
  • Products may contain or come into contact with allergens including nuts, dairy, gluten, soy, egg and sesame.
  • Customers are responsible for assessing product suitability for dietary requirements.
  • To the maximum extent permitted by law, Deli Fresco accepts no liability for allergic reactions.

8. Consumer Guarantees

Nothing in these Terms excludes your rights under the Australian Consumer Law. Where goods fail to meet a consumer guarantee, you may be entitled to a remedy.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We exclude all liability for indirect, incidental or consequential loss.
  • Where liability cannot be excluded, our liability is limited (at our option) to replacement of the goods or refund of the purchase price.

10. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.
